ACCEPTANCE OF TERMS

dns@insidesystems.net is an Internet-based Web service that contains DNS hosting and other Internet related services that consists of (but not limited to) DNS Hosting, Dynamic DNS, and URL Redirection. Inside Systems, Inc. (hereafter "IS"), provides the Services subject to the terms and conditions set forth in this Terms Of Service ("TOS").


By using the IS services you are indicating your agreement to be bound by all of the terms and conditions of the TOS along with the Warranty, Indemnification, and the Legal Disclaimer.

CHANGE OF SERVICES

If IS finds it impossible to offer services at current pricing we reserve the right to change account offerings at anytime. We can not just charge higher fees automatically, but we do reserve the right to limit services that may have been "unlimited" or have high limits before. These changes can be caused by increase in network /support costs that the IS services take to operate.

ACCEPTABLE USE

IS reserves the right to revoke without refund or notice any of IS services and the entire customer account. IS can decide to take this action if IS feels that the customer account has been used for the following activities (but not limited to):

  • using IS to hide your true identity - for this reason all domains used in our system must have correct and lawful whois entries / listings
  • transmitting Unsolicited Commercial Email (UCE)
  • transmitting bulk email
  • hosting a site (even with HTTP Redirection) that uses (but not limited to) bulk email, UCE, spam to advertise
  • hosting a site that may have affiliates tht will spam, create UCE or UBE
  • using (but not limited to) bulk email, UCE, spam to advertise any DNS record or redirection record or any service hosted by IS
  • posting bulk Usenet articles
  • Denial of Service attacks of any kind
  • copyright infringement
  • misrepresentation of any service or product including IS services
  • the act of reselling or attempting to resell an account of IS's services. This means that you can not purchase an account of 50 domains and sell it to 50 different people and give each one the user name and password for the account
  • unlawful or illegal activities of any kind causing loss or creating service degradation for other IS users whether intentional or inadvertent

NETWORK ABUSE / CONDUCT

IS has the right to terminate any domain or account if the network traffic associated with the domain or account exceeds acceptable use. (All domains exceeding 50 queries per second will be investigated.) Usually a higher TTL is all that is needed to fix the problem. IS reserves the right to make record modifications at anytime. However if a users domains constantly receive massive queries then your domain / account will be removed.


IS has the right to terminate any account that does not provide truthful and correct contact information. We require the correct contact information for notification purposes (we do not sell any of this information, we do not like spam either). Wrong information results in abuse of our staff's time trying to track down the correct individuals.

CUSTOMER CONDUCT

Customer is solely responsible for the contents of his/her usage of Service. Customer's use of the Service is subject to all applicable local, state, national, and international laws and regulations. Customer agrees:

  1. to comply with US law regarding the transmission of technical data exported from the United States through the service;
  2. not to use the Service for illegal purposes;
  3. not to interfere with or disrupt networks connected to the Service;
  4. to comply with all regulations, policies, and procedures of networks connected to the Service.

The Service makes use of the Internet's DNS protocol to create and delegate domains; therefore, Customer's conduct is subject to Internet regulations, policies, and procedures. Customer will not use the Service for illegal software, junk pornography, spamming or any use of distribution lists to any person who has not given specific permission to be included in such a process. Customer agrees not to transmit through the service any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature. Customer further agrees not to transmit any material that encourages conduct that could constitute a criminal offense, give rise to civil liability or otherwise violate any applicable local, state, national, or international law or regulation. Attempts to gain unauthorized access to other computer systems are prohibited. Customer shall not interfere with another Customer's use and enjoyment of the Service or another entity's use and enjoyment of similar services. IS may, at its sole discretion, immediately terminate Service should Customer's conduct fail to conform with these terms and conditions of the TOS.

TERMINATION OF SERVICE

Customer may terminate this Agreement and User's right to use the Service by contacting IS. All refunds may result in loss of fees paid. IS may terminate your account or access rights to this Service at any time, without notice, for conduct that IS believes violates this Agreement or other policies or guidelines that IS has posted. IS may terminate your account or access rights to all services for online conduct that IS believes is harmful to other Customers, to IS's business, or to other information providers.
